TOPICS TO BE DISCUSSED:
In this all day seminar and workshop, Mr. Mura and other attorneys from the firm will be presenting and discussing the most significant 2008-2009 case law, statutory and regulatory developments in the area of property, casualty and liability insurance. A comprehensive handout synopsizing all coverage cases (with complete index for all previous handouts) decided by New York state and federal courts from July 2008 through June 2009 will be provided to those attending.
Property issues will include: judicial interpretation of named perils and policy exclusions; late notice; the cooperation clause; appraisal; mortgagee rights and responsibilities; consequential damages; EUO procedure; proofs of loss; fraud; arson; material misrepresentation; subrogation and first-party insurer "bad faith".
Liability/casualty issues will include: late notice; intentional acts claims; no-fault issues; rental car coverage; judicial interpretation of key policy exclusions; UM and SUM (UIM) coverage issues; promises to procure insurance; additional insureds; NY Ins. Law 3420(d) and the perils of untimely or incomplete disclaimers/denials of coverage; and third-party insurer "bad faith"
